This book engages in an analysis of the ideals of freedom and social justice. Rolle examines and questions Appeal to the Colored Citizens of the World by David Walker, which encourages slaves to embrace a theologically-based understanding of freedom and participate in insurrectionist activities to overthrow slavery.

Firearm violence in the United States produces over 36,000 deaths and 74,000 sustained firearm-related injuries yearly. The paper describes the burden of firearm violence with emphasis on the disproportionate burden on children, racial/ethnic minorities, women and the healthcare system. Second, this paper identifies factors that could mitigate the burden of firearm violence by applying a blend of key ethical theories to support population level interventions and recommendations that may restrict individual rights. Such recommendations can further support targeted research to inform (...) and implement interventions, policies and laws related to firearm access and use, in order to significantly reduce the burden of firearm violence on individuals, health care systems, vulnerable populations and society-at-large. By incorporating a blended public health ethics to address firearm violence, we propose a balance between societal obligations and individual rights and privileges. (shrink)

Peer review is a widely accepted instrument for raising the quality of science. Peer review limits the enormous unstructured influx of information and the sheer amount of dubious data, which in its absence would plunge science into chaos. In particular, peer review offers the benefit of eliminating papers that suffer from poor craftsmanship or methodological shortcomings, especially in the experimental sciences. However, we believe that peer review is not always appropriate for the evaluation of controversial hypothetical science. We argue that (...) the process of peer review can be prone to bias towards ideas that affirm the prior convictions of reviewers and against innovation and radical new ideas. Innovative hypotheses are thus highly vulnerable to being “filtered out” or made to accord with conventional wisdom by the peer review process. Consequently, having introduced peer review, the Elsevier journal Medical Hypotheses may be unable to continue its tradition as a radical journal allowing discussion of improbable or unconventional ideas. Hence we conclude by asking the publisher to consider re-introducing the system of editorial review to Medical Hypotheses. (shrink)

In this article, I explore the auditory technopolitics of prenatal sound systems, asking what kinds of futures, listeners and temporalities they seek to produce. With patents for prenatal audio apparatus dating back to the late 1980s, there are now a range of devices available to expectant parents. These sound technologies offer multiple benefits: from soothing away stress to increasing the efficiency of ultrasonic scans. However, one common point of emphasis is their capacity to accelerate foetal ‘learning’ and cognitive development. Taking (...) as exemplary the Babypod and BabyPlus devices, I argue that prenatal sound systems make audible a particular figuration of pregnancy and gestational labour that combines divergent notions of responsibility and passivity. Contra the equation of neoliberalism with self-control and individualism, I argue that prenatal sound systems amplify neoliberal capitalism’s elision of personal, maternal and familial responsibility. As reproductive sound technologies, prenatal sound systems facilitate maternal–familial investment in the pre-born as future-child. Consequently, financialised notions of inheritance are substituted for biological inheritance. Drawing attention to the common rhetorical figuration of the sonic as womb-like, furthermore, I argue that prenatal sound systems exemplify what I refer to as uterine audiophilia. By treating the womb as ‘the perfect classroom’, prenatal sound systems imply an intense maternal obligation to invest in and impress upon the future-child, while also envisioning the pregnant person’s body as an occupied, resonant space. Cohering with a fidelity discourse that posits the reproductive medium as passive container and a source of noise that is to be overcome, uterine audiophilia relies upon politically regressive conceptualisations of pregnancy. I thus argue that these devices mark the hitherto under-theorised convergence of auditory culture, technology and reproductive politics. (shrink)

This is a report on the Doctoral Consortium co-located with the 17th International Conference on Artificial Intelligence and Law in Montreal.

Experiential evidence shows that pain is associated with common meanings. These include a meaning of threat or danger, which is experienced as immediately distressing or unpleasant; cognitive meanings, which are focused on the long-term consequences of having chronic pain; and existential meanings such as hopelessness, which are more about the person with chronic pain than the pain itself. This interdisciplinary book - the second in the three-volume Meanings of Pain series edited by Dr Simon van Rysewyk - aims to better (...) understand pain by describing experiences of pain and the meanings these experiences hold for the people living through them. The lived experiences of pain described here involve various types of chronic pain, including spinal pain, labour pain, rheumatic pain, diabetic peripheral neuropathic pain, fibromyalgia, complex regional pain syndrome, endometriosis-associated pain, and cancer-related pain. Two chapters provide narrative descriptions of pain, recounted and interpreted by people with pain. Language is important to understanding the meaning of pain since it is the primary tool human beings use to manipulate meaning. As discussed in the book, linguistic meaning may hold clues to understanding some pain-related experiences, including the stigmatisation of people with pain, the dynamics of patient-clinician communication, and other issues, such as relationships between pain, public policy and the law, and attempts to develop a taxonomy of pain that is meaningful for patients. Clinical implications are described in each chapter. This book is intended for people with pain, their family members or caregivers, clinicians, researchers, advocates, and policy makers. (shrink)

This paper reports a literature review on the topic of ethical issues in in-depth interviews. The review returned three types of article: general discussion, issues in particular studies, and studies of interview-based research ethics. Whilst many of the issues discussed in these articles are generic to research ethics, such as confidentiality, they often had particular manifestations in this type of research. For example, privacy was a significant problem as interviews sometimes probe unexpected areas. For similar reasons, it is difficult to (...) give full information of the nature of a particular interview at the outset, hence informed consent is problematic. Where a pair is interviewed (such as carer and cared-for) there are major difficulties in maintaining confidentiality and protecting privacy. The potential for interviews to harm participants emotionally is noted in some papers, although this is often set against potential therapeutic benefit. As well as these generic issues, there are some ethical issues fairly specific to in-depth interviews. The problem of dual role is noted in many papers. It can take many forms: an interviewer might be nurse and researcher, scientist and counsellor, or reporter and evangelist. There are other specific issues such as taking sides in an interview, and protecting vulnerable groups. Little specific study of the ethics of in-depth interviews has taken place. However, that which has shows some important findings. For example, one study shows participants are not averse to discussing painful issues provided they feel the study is worthwhile. Some papers make recommendations for researchers. One such is that they should consider using a model of continuous (or process) consent rather than viewing consent as occurring once, at signature, prior to the interview. However, there is a need for further study of this area, both philosophical and empirical. (shrink)

Nearly one in every 100 adults in the United States is in jail or prison today. In a period dominated by calls to roll back the government in all areas of social and economic policy, we have witnessed its massive expansion in the realm of penal policy since the 1970s. The U.S. incarceration rate is now more than 737 per 100,000 people, or five to 12 times the rate of Western European countries and Japan . The reach of the U.S. (...) carceral state extends far beyond the 2.2 million men and women currently in prison or jail in the United States. On any given day, over 7 million people__or 1 in every 32 adults__are incarcerated or on probation or parole . This rate of state supervision is unparalleled in U.S. history.These overall figures on incarceration belie the enormous and disproportionate impact that this bold and unprecedented social experiment has had on certain groups in U.S. society. If current trends continue, one in three black men and one in six Hispanic men are expected to spend some time in jail or prison during their lives . The number of incarcerated African_American men has grown so rapidly over the past quarter_century that today more black men are behind bars than enrolled in colleges and universities .[1]Some contend that growing public dismay over the crushing economic burden of incarcerating and monitoring so many people heralds the beginning of the end of the prison boom . As evidence, they point to recent penal developments in the states. Severe budget deficits prompted by the 2001 recession forced some states to close prisons and lay off guards. Dozens of states experimented with new sentencing formulas, mostly directed at nonviolent offenders.[2] Fiscally conservative Republicans previously known for being penal hard_liners championed some of these recent relaxations in penal policy. This fueled speculation that law_and_order Republicans, troubled by mounting costs, are well poised to roll back the carceral state, much as red_baiter Richard Nixon was ideally situated to breach the great political wall with China.We should be cautious, however, about assuming that fiscal pressures and the recent softening of public opinion sparked by the plummeting crime rate over the past decade will automatically forge a durable consensus that will dismantle the carceral state.[3] It was mistakenly assumed three decades ago that shared disillusionment on the right and the left with the rehabilitative ideal would shrink the prison population. Instead, it exploded. Criminal justice policies often confound conventional distinctions between left and right, particularly on issues related to crime victims. The relationship between political leaders, social movements, interest groups, and governing institutions is highly contingent and volatile in the case of penal policy because the left_right divide is more blurred and because of certain institutional features of the U.S. criminal justice system and welfare state.[4]While economic arguments against the carceral state are important and compelling, they have their limitations. If properly pitched, they can help forge a consensus to reverse the prison boom. But they can also be used to propel mean_spirited budget cuts that do not significantly reduce the size of the prison population__or save much money__ but do render life in prison and life after prison leaner and meaner. Criminal justice reform to reverse the prison boom is a highly fragile project that cannot be underwritten primarily by fiscal concerns. Without some broader vision and movement for change, the U.S. carceral state, trimmed down a little by a few modest sentencing and drug law reforms, will be here to stay. Such a movement is beginning to coalesce in the United States. Opponents have begun to portray the carceral state not only as a financial liability but also as a moral liability and a pressing civil and human rights issue that perverts cherished democratic institutions, like the right to vote. They have also begun to focus public attention on how the prison boom has exacerbated economic and social inequalities and is a growing menace to public health. (shrink)

War Kollektivität einmal eine fast unsichtbare Dimension künstlerischer Produktionsprozesse, ist sie heute zu einem zentralen Wert des Kunstfelds geworden: Großausstellungen und Kunstpreise stellen das Kollektive offen in den Vordergrund. In diesem Beitrag wird diese Entwicklung entlang einiger Theorien des Kollektiven nachvollzogen, darunter Howard Beckers Konzept der Kunstwelten, Grant Kesters Begriff der Kollaboration, Judith Butlers Theorie der performativen Versammlung sowie Kai van Eikels Begriff des Synchronisierens. So wird zunächst aufgezeigt, was sich an einem in Kunstdiskursen verbreiteten Verständnis von Kollektivität geändert hat. (...) Im zweiten Schritt werden einige gesellschaftliche Faktoren skizziert, die bei dem qualitativen Wandel der Konzepte, aber auch der quantitativen Konjunktur des Kollektiven eine Rolle spielten: der Neoliberalismus und Singularisierungsprozesse. Caring for the competent, fragile, elderly patient at the end of life is becoming increasingly challenging. This case explores several ethical areas of concern that arise when caring for patients who have written durable powers of attorney for health care decisions and face life or death choices. Areas covered are informed consent with the elderly patient, the family's right to be involved in decision-making, futility of treatment, and the nurse's role as patient advocate during times of difficult decision-making. In lieu of an abstract, here is a brief excerpt of the content:Human Gene TherapyMary Carrington Coutts (bio)On September 14, 1990, researchers at the U.S. National Institutes of Health (NIH) performed the first approved gene therapy procedure on a four-year-old girl named Ashanti DeSilva. Born with a rare genetic disease, severe combined immune deficiency (SCID), Ashanti lacked a healthy immune system and was extremely vulnerable to infection. Children with SCID usually develop overwhelming infections and rarely survive to adulthood; even a (...) common childhood illness like chicken pox is life-threatening. Ashanti led a cloistered existence, avoiding contact with people outside her family, remaining in the sterile environment of her home, and battling frequent illnesses with massive amounts of antibiotics.In Ashanti's gene therapy procedure, her own white blood cells were genetically modified and then infused back into her bloodstream. Laboratory tests show that the therapy has strengthened Ashanti's immune system. She no longer has recurrent colds, has been allowed to attend school, and has been immunized against whooping cough. This gene therapy procedure is not a cure, however. The genetically-treated white blood cells only survive for a few months and must then be replaced, but Ashanti's future is much brighter because of the new therapy (VI, Thompson [The First] 1993).Although this simplified description of Ashanti's gene therapy procedure sounds like a happy ending, it is little more than an optimistic chapter in a long story. The road to the first approved gene therapy procedure was rocky and fraught with controversy. The biology of human gene therapy is very complex, and there are still many techniques that need to be developed and diseases that need to be understood more fully before gene therapy is well established. The public policy debate surrounding the possible use of genetically engineered material in human subjects is equally complex. Major participants in the debate come from the fields of biology, government, law, medicine, philosophy, politics, and religion, each bringing different views to the discussion.In studying the ethics of gene therapy, one should draw a distinction between [End Page 63] therapy on somatic (non-reproductive) cells and germ (reproductive) cells. Only the germ cells carry the genes that will be passed on to the next generation. Reactions to gene therapy have varied widely. Some commentators on gene therapy object to any form of genetic manipulation, no matter how well-intentioned (VI, Rifkin 1983). Another reaction is to allow the use of somatic-cell therapy, but not to approve the use of germ-line therapy, which could have unforeseeable effects on future generations. A different stance is that, with proper regulation and safeguards, germ-line gene therapy is a logical extension of the progress made to date and that it is an ethically acceptable procedure.TechniquesTo date, 43 research protocols have been approved for somatic-cell gene therapy in the United States. The techniques employed in each protocol vary, but in general a virus is used as a "vector" to insert the desired gene into the DNA of the patient's cells, in order to compensate for a defective gene. For Ashanti's gene therapy, this technique involved obtaining white blood cells and introducing properly functioning genes into as many of the cells as possible. The normal genes were delivered through the use of a specially-engineered virus.Although similar techniques are used in germ-line gene therapy, the procedure is more difficult. There are two basic ways to perform germ-line gene therapy: (1) to treat a preimplantation embryo that carries a serious genetic defect before its implantation in the mother, which necessitates the use of in vitro fertilization techniques; or (2) to treat the germ cells (sperm or egg cells) of afflicted adults so that the genetic defects would not be passed on to their offspring, which requires the technical expertise to delete the defective gene and insert a properly functioning replacement. Though I doubt it has put a Rolls Royce in anybody’s garage, the criticism industry is a reality not to be overlooked. Academics have a responsibility to stay self-aware and self-critical about their own and their profession’s interests. All academic activity has a careerist dimension, but it obviously cannot be explained by that dimension alone, and in this sense Fromm’s point is simply reductive. But of course it is not all academic activity that Fromm is objecting to, only some and (...) notably mine.The image of academic colonization suggests one has stepped beyond some legitimate borders and laid claim to territory rightfully inhabited by others. Whose world was invaded by my essay, or by the “Race,” Writing, and Difference issue in general? Mr. Fromm’s, evidently. Fromm wants a world where words stand still and refer, and don’t get changed. In particular, to use his own examples, he wants a world where blacks are blacks, whites are whites, Americans are Americans, knives are knives, brothers are brothers, and Indians are Indians . The account of the death of Patroklos occupies a strategic position in the narrative economy of the Iliad: before this event, Achilles has withdrawn from combat out of indignation against Agamemnon; afterwards, his anger turns against Hector, whom he holds responsible for his friend's death. Achilles returns to battle and kills Hector in an act of vengeance that, as we have known from the beginning of the poem, will lead to his own demise, which is not actually recounted in the (...) Iliad. This episode stands out because it is atypical both in the contents of the narration and in the means of expression used (what are generally termed “formulas”). I will give some examples of these oddities and then propose an interpretation. Here is the text, in the translation by Richmond Lattimore:So long as the sun was climbing still to the middle heaven, so long the thrown weapons of both took hold, and men dropped under them; but when the sun had gone to the time for unyoking of cattle, then beyond their very destiny the Achaians were stronger and dragged the hero Kebriones from under the weapons and the clamour of the Trojans, and stripped the armour from his shoulders. The world I grew up in believed that change and development in life are part of a continuous process of cause and effect, minutely and patiently sustained throughout the millenniums. With the exception of the initial act of creation ..., the evolution of life on earth was considered to be a slow, steady and ultimately demonstrable process. No sooner did I begin to read history, however, than I began to have my doubts. Human society and living beings, it seemed to (...) me, ought to be excluded from so calm and rational a view. The whole of human development, far from having been a product of steady evolution, seemed subject to only partially explicable and almost invariably violent mutations. Entire cultures and groups of individuals appeared imprisoned for centuries in a static shape which they endured with long-suffering indifference, and then suddenly, for no demonstrable cause, became susceptible to drastic changes and wild surges of development. It was as if the movement of life throughout the ages was not a Darwinian caterpillar but a startled kangaroo, going out towards the future in a series of unpredictable hops, stops, skips and bounds. Indeed, when I came to study physics I had a feeling that the modern concept of energy could perhaps throw more light on the process than any of the more conventional approaches to the subject. It seemed that species, society and individuals behaved more like thunder-clouds than scrubbed, neatly clothed and well-behaved children of reason. In einer stark männlich geprägten US-amerikanischen Politik trat Hillary Clinton 2016 als erste aussichtsreiche weibliche Präsidentschaftskandidatin an. Ihr Gegenkandidat Donald Trump nahm dies zum Anlass, im Wahlkampf wiederholt mit diffamierenden, oft sexistischen Kommentaren auf sich aufmerksam zu machen. Gender und konkret Hillary Clintons Feminität rückten damit in den Vordergrund des polarisierenden und feindseligen Wahlkampfes. Clinton stand in drei TV-Duellen ihrem Kontrahenten gegenüber und versuchte, die Bürger*innen von ihren Kompetenzen als Frau für das höchste politische Amt der USA zu überzeugen. Studien (...) zu Wahlverhalten zeigen, dass die Entscheidung der Wähler*innen am Tag der Wahl nicht bloß davon abhängt, welche Argumente und Positionen die Politiker*innen in den Debatten anführen und vertreten. TV-Duelle nehmen verstärkt eine zentrale Rolle für den Ausgang der Wahlen ein. Dieses Buch analysiert den Genderaspekt (konkret Clintons Feminität) in den drei TV-Debatten und untersucht, inwiefern Clintons Weiblichkeit von Trump als Nachteil dargestellt, von Clinton selbst jedoch als Vorteil genutzt wurde, um rhetorisch zu punkten. Hierzu werden die Debatten- und Kommunikationsstrategien der beiden Politiker*innen systematisch analysiert. Die Autorin Lisa Marie Simmack absolvierte ihren Master of Arts in Politikwissenschaft an der Leibniz Universität Hannover. In his article, ‘Social constructionism and climate science denial’, Hansson claims to present empirical evidence that the cultural theory developed by Dame Mary Douglas, Aaron Wildavsky and ourselves leads to science denial. In this reply, we show that there is no validity to these claims. First, we show that Hansson’s empirical evidence that cultural theory has led to climate science denial falls apart under closer inspection. Contrary to Hansson’s claims, cultural theory has made significant contributions to understanding and addressing climate (...) change. Second, we discuss various features of Douglas’ cultural theory that differentiate it from other constructivist approaches and make it compatible with the scientific method. Thus, we also demonstrate that cultural theory cannot be accused of epistemic relativism. (shrink)

Ziel dieser Untersuchung ist, Ursachen und Faktoren zu ermitteln, die in der Entstehung und Verstärkung von Bildungsungleichheit im iranischen Bildungssystem wirksam sind. Diese Forschung wurde gemäß einem qualitativen Paradigma unter Verwendung der Methode der “Grounded Theory” durchgeführt. Die Daten wurden von einer Fokusgruppe, bestehend aus 20 Teilnehmern, mithilfe der Methode des Tiefeninterviews erhoben. Die Teilnehmer wurden nach dem Prinzip der maximalen Streuung und unter Berücksichtigung des Sättigungspunkts durch eine gezielte Auswahl ausgewählt. Für die Datenanalyse wurde der interpretativ-absorptive Ansatz verwendet. Die (...) Ergebnisse der qualitativen Analyse zeigten, dass einerseits die Bildungsungleichheit im iranischen Bildungssystem von den sozialen und wirtschaftlichen Ungleichheiten in der Gesellschaft beeinflusst wird, und andererseits das Bildungssystem des Landes und die Struktur, die es regiert, Faktore für die Verstärkung und Ausweitung der Ungleichheiten sind. Nach den Forschungsergebnissen kann mit Sicherheit gesagt werden, dass in der gegenwärtigen Struktur des Bildungswesens der Hauptrahmen des Bildungssystems des Landes, einschließlich der Prinzipien, Ziele, Inhalte, Methoden, Erzieher, und Lernenden, jeweils auf eine bestimmte Art und Weise eine spezifische Rolle bei der Bildungsungleichheit und Ungerechtigkeit in der Gesellschaft spielen. In a recent issue of Journal of Medical Ethics, we discussed the ethical review of evaluations of interventions that would occur whether or not the evaluation was taking place. We concluded that standard research ethics frameworks including the Ottawa Statement, which requires justification for all aspects of an intervention and its roll-out, were a poor guide in this area. We proposed that a consideration of researcher responsibility, based on the consequences of the research taking place, would be a more appropriate (...) way delineate the scope of research ethics review. Weijer and Taljaard present a counterargument to our proposal, which we address in this reply. They claim that a focus on researcher responsibility will weaken the protection of research participants and link it to ‘unethical research’ and a ‘government experimenting on its own people’. However, the moral responsibility of researchers is defined in terms of the consequences of the research on human welfare and harm, not in opposition to it. Weijer and Taljaard argue that researchers must justify what they are studying whether or not they have any control over it and that governments must justify their programmes, including by demonstrating equipoise, to a research ethics committee if they implement them in a randomised way. We strongly disagree that this is a defensible way to define the scope of research ethics review and argue that this provides no further protections to research participants beyond what we propose, but places a potential barrier to learning from government programmes. This article investigates a series of additions made to JRL Gaster MS 2037, a newly identified copy of Peter of Poitier‘s Compendium historiae in genealogia Christi. Following a detailed description and dating of the manuscript, it investigates two sets of additions to the roll in depth. It establishes that the first motive behind the inclusion of such additions was educative – serving to extend the historic information given in the Compendium, while the second motive was devotional – elevating the status (...) of the Virgin Mary through the enhancement of her genealogical record. Given the fact that the manuscript was produced in the mid-fifteenth century, this focus on the Virgin likely had a polemic purpose, situating the manuscript in the context of debates over the Immaculate Conception, and using Alexander Nequams Expositio super Cantica canticorumto this end. In identifying the sources used, as well as the limits on the compiler imposed by the physical form of the roll, this examination of Gaster MS 2037 offers an insight into the later reception of this popular text. A leader in the modern commentary on ethics and philosophy, Mary Warnock casts a critical eye over her life and times.

This selection consists of extracts from writings of women concerned solely with the pursuit of abstract ideas, historically contextualized. The texts, for the most part, reflect issues widely debated in their contemporary societies. Extracts from lesser-known writers are also included, providing a diversity of arguments spanning four centuries and including some notable contemporary philosophers.

Synthetic biology is often seen as the engineering turn in biology. Philosophically speaking, entities created by synthetic biology, from synthetic cells to xenobots, challenge the ontological divide between the organic and inorganic, as well as between the natural and the artificial. Entities such as synthetic cells can be seen as hybrid or transitory objects, or neo–things. However, what has remained philosophically underexplored so far is the impact these hybrid neo–things will have on (our phenomenological experience of) the living world. By (...) extrapolating from Walter Benjamin’s account of how technological reproducibility affects the aura of art, we embark upon an exploratory inquiry that seeks to fathom how the technological reproducibility of life itself may influence our experience and understanding of the living. We conclude that, much as technologies that enabled reproduction corroded the aura of original artworks (as Benjamin argued), so too will the aura of life be under siege in the era of synthetic lifeforms. This article zooms in on a specific case study, namely the research project Building a Synthetic Cell (BaSyC) and its mission to create a synthetic cell–like entity, as autonomous as possible, focusing on the properties that differentiate organic from synthetic cells.
